A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to an election to repeal a photographic traffic signal |
|
enforcement system ordinance. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 707, Transportation Code, is amended by |
|
adding Section 707.0022 to read as follows: |
|
Sec. 707.0022. ELECTION TO REPEAL ORDINANCE. (a) The |
|
governing body of a local authority shall submit to the voters of |
|
the local authority the question of repealing an ordinance adopted |
|
under Section 707.002 if the governing body receives a petition |
|
that requests the election and is signed by 10 percent of the |
|
registered voters of the local authority. |
|
(b) If a majority of the votes cast at the election favor the |
|
repeal of the ordinance, the governing body: |
|
(1) shall repeal the ordinance; and |
|
(2) may not subsequently adopt an ordinance under |
|
Section 707.002. |
|
(c) An election on the question of repealing an ordinance |
|
under Section 707.002 may not be held more often than every two |
|
years. |
|
SECTION 2. This Act takes effect September 1, 2015. |
