A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the offense of contributing to truancy by a parent; |
|
increasing a criminal penalty. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 25.093, Education Code, is amended by |
|
amending Subsection (c) and adding Subsection (c-2) to read as |
|
follows: |
|
(c) An offense under Subsection (a) is a misdemeanor, |
|
punishable by a fine [only,] in an amount not to exceed: |
|
(1) $250 and by not less than eight hours of community |
|
service [$100] for a first offense; |
|
(2) $350 and by not less than 16 hours of community |
|
service [$200] for a second offense; |
|
(3) $450 and by not less than 24 hours of community |
|
service [$300] for a third offense; or |
|
(4) [$400 for a fourth offense; or
|
|
[(5)] $500 and by not less than 32 hours of community |
|
service for a fourth [fifth] or subsequent offense. |
|
(c-2) A defendant required to perform community service |
|
under this section after conviction of an offense under Subsection |
|
(a) shall perform school-based community service in the county in |
|
which the defendant resides. |
|
SECTION 2. The change in law made by this Act applies only |
|
to an offense committed on or after the effective date of this Act. |
|
An offense committed before the effective date of this Act is |
|
governed by the law in effect on the date the offense was committed, |
|
and the former law is continued in effect for that purpose. For |
|
purposes of this section, an offense was committed before the |
|
effective date of this Act if any element of the offense occurred |
|
before that date. |

SECTION 3. This Act takes effect September 1, 2019. |
