A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the obligation of a defendant to pay court-ordered |
|
|
restitution. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Article 42.037, Code of Criminal Procedure, is |
|
|
amended by adding Subsection (h-1) to read as follows: |
|
|
(h-1) The duty to pay the restitution ordered under this |
|
|
article remains with the defendant until full restitution is paid, |
|
|
regardless of whether the defendant is serving a term of |
|
|
confinement or is under any form of state supervision. The amount of |
|
|
any unpaid restitution ordered under this article: |
|
|
(1) is subject to withdrawal from an inmate account in |
|
|
accordance with Section 501.014, Government Code, if the defendant |
|
|
is confined in a facility operated by or under contract with the |
|
|
Texas Department of Criminal Justice; and |
|
|
(2) may be collected as a condition of community |
|
|
supervision, parole, or mandatory supervision, if the defendant is |
|
|
under state supervision. |

SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2013. |
