A BILL TO BE ENTITLED
 
AN ACT
  relating to mandatory supervision for certain inmates sentenced
  following violation of a condition of community supervision.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter E, Chapter 508, Government Code, is
  amended by adding Section 508.1491 to read as follows:
         Sec. 508.1491.  MANDATORY SUPERVISION FOR CERTAIN INMATES
  SENTENCED FOLLOWING VIOLATION OF CONDITION OF COMMUNITY
  SUPERVISION.  Sections 508.149(b), (c), and (d) do not apply to an
  inmate serving a sentence imposed following a violation of a
  condition of community supervision resulting in an adjudication of
  guilt on the original charge, unless:
               (1)  the violation constituted the commission of an
  offense other than an offense involving the operation of a motor
  vehicle punishable by fine only; or
               (2)  the original charge for which the inmate is
  serving a sentence is based on the commission of an offense for
  which registration as a sex offender is required under Chapter 62,
  Code of Criminal Procedure.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2013.
