A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to intervention by the attorney general in a suit |
|
|
involving recognition of a same-sex marriage or civil union. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 6.204, Family Code, is amended by adding |
|
|
Subsection (d) to read as follows: |
|
|
(d) The attorney general may intervene in a suit involving a |
|
|
right or claim asserted as a result of a marriage between persons of |
|
|
the same sex or a civil union at any time before the 90th day after |
|
|
the date a judgment is rendered in the suit. |
|
|
SECTION 2. The change in law made by this Act applies to a |
|
|
suit that is pending in a trial court on the effective date of this |
|
|
Act or filed on or after that date. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2011. |
