A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to membership in the structural pest control advisory |
|
committee. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 1951.101, Occupations Code, is amended |
|
to read as follows: |
|
Sec. 1951.101. COMMITTEE MEMBERSHIP. (a) The committee |
|
consists of nine members appointed by the commissioner as follows: |
|
[(1)
two members who are experts in structural pest
|
|
control application;
|
|
[(2)] (1) three members who represent the public; |
|
[(3)
one member from an institution of higher
|
|
education who is knowledgeable in the science of pests and pest
|
|
control;
|
|
[(4)] (2) three [one] members who represent[s] the |
|
interests of structural pest control operators and who are [is] |
|
appointed based on recommendations provided by a trade association |
|
of operators; |
|
[(5)] (3) three [one] members who represent[s] the |
|
interests pest control operators involved in school integrated pest |
|
management [of consumers; and
|
|
[(6)
the commissioner of state health services or the
|
|
commissioner's designee]. |
|
(b) Members of the committee serve staggered four-year |
|
terms. The terms of four or five members, as appropriate, expire on |
|
February 1 of each odd-numbered year. |
|
(c) Service on the committee by a state officer or employee |
|
is an additional duty of the member's office or employment. |
|
(d) Appointments to the committee shall be made without |
|
regard to the race, color, disability, sex, religion, age, or |
|
national origin of the appointee. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2011. |
