A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the board of directors of a public utility agency. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 572.057, Local Government Code, is |
|
amended by amending Subsection (b) and adding Subsections (b-1) and |
|
(c-1) to read as follows: |
|
(b) Except as provided by Subsection (b-1), each [Each] |
|
director must be appointed by place by the governing bodies of the |
|
participating public entities. Each participating public entity is |
|
entitled to appoint at least one director. |
|
(b-1) If a public utility agency has a service area that |
|
includes the unincorporated area of a county that is outside the |
|
boundaries of the agency's participating public entities, the |
|
commissioners court of the county may appoint the same number of |
|
directors as the number appointed by the participating public |
|
entity with the largest population that is less than the population |
|
of the unincorporated area. |
|
(c-1) A director must be a customer of the public utility |
|
agency and reside within the area served by the agency. |
|
SECTION 2. Section 572.057(c-1), Local Government Code, as |
|
added by this Act, applies only to the term of a director that |
|
begins on or after the effective date of this Act. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2021. |
