A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to prohibitions on the use of a wireless communication |
|
|
device while using certain motor vehicles. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 545.425(c), Transportation Code, is |
|
|
amended to read as follows: |
|
|
(c) Unless the vehicle is stopped, an [An] operator may not |
|
|
use a wireless communication device while operating: |
|
|
(1) a passenger bus; or |
|
|
(2) a vehicle that is used to transport clients of the |
|
|
business or public entity that owns or leases the vehicle, |
|
|
including a vehicle owned or leased by: |
|
|
(A) an institution that holds a license issued |
|
|
under Chapter 242, Health and Safety Code; |
|
|
(B) a facility that holds a license issued under |
|
|
Chapter 246 or 247, Health and Safety Code; or |
|
|
(C) an entity that provides special |
|
|
transportation services to persons who are disabled or elderly |
|
|
[with a minor passenger on the bus unless the passenger bus is
|
|
|
stopped]. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to an offense committed on or after the effective date of this Act. |
|
|
An offense committed before the effective date of this Act is |
|
|
subject to the law in effect on that date, and that law is continued |
|
|
in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2011. |
