A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the distribution, sale, or offer for sale of a |
|
|
mislabeled abusable synthetic substance through the Internet. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 484.001(2), Health and Safety Code, is |
|
|
amended to read as follows: |
|
|
(2) "Business" includes trade and commerce and |
|
|
advertising, selling, and buying service or property and the use of |
|
|
the Internet to perform these activities. |
|
|
SECTION 2. (a) The change in law made by this Act to Section |
|
|
484.001(2), Health and Safety Code, applies only to conduct |
|
|
constituting an offense or forming the basis for a civil cause of |
|
|
action that accrues on or after the effective date of this Act. |
|
|
(b) For purposes of this section, an offense was committed |
|
|
before the effective date of this Act if any element of the offense |
|
|
occurred before that date. |
|
|
SECTION 3. This Act takes effect September 1, 2017. |
