A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the powers of certain hospital districts regarding |
|
|
district properties and facilities. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. The heading to Section 281.0511, Health and |
|
|
Safety Code, is amended to read as follows: |
|
|
Sec. 281.0511. CONTRACTING AUTHORITY AND POWERS RELATING TO |
|
|
PROPERTY AND FACILITIES OF CERTAIN DISTRICTS. |
|
|
SECTION 2. Section 281.0511, Health and Safety Code, is |
|
|
amended by adding Subsection (c) to read as follows: |
|
|
(c) Notwithstanding Section 281.050, the board may lease |
|
|
any property, or hospital facility without the approval of the |
|
|
commissioners court. The board must post public notice of any |
|
|
proposed transaction under this subsection as required by Chapter |
|
|
551, Government Code. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2011. |
