A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the payment of resident tuition and fees by certain high |
|
school students who enroll in dual credit courses. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter B, Chapter 54, Education Code, is |
|
amended by adding Section 54.0551 to read as follows: |
|
Sec. 54.0551. RESIDENT TUITION AND FEES FOR CERTAIN HIGH |
|
SCHOOL STUDENTS ENROLLED IN DUAL CREDIT COURSES. (a) This section |
|
applies only to a dual credit course or other course for which a |
|
student may earn joint high school and college credit. |
|
(b) For purposes of determining the rates of tuition and |
|
fees that an institution of higher education may charge a high |
|
school student enrolled in a course described by Subsection (a), a |
|
high school student is entitled to pay tuition and fees for the |
|
course at the rates provided for residents of this state if the |
|
student satisfies the requirements of Section 54.052(a)(1). The |
|
institution shall determine whether the student is entitled to pay |
|
tuition and fees at resident rates under this section without |
|
reference to whether the student is a dependent for purposes of |
|
Section 54.052(a)(2), and the presumption provided by Section |
|
54.052(b) does not apply to the determination. |
|
(c) This section does not affect the determination of a |
|
student's resident status for purposes of this title. |
|
SECTION 2. The change in law made by this Act applies |
|
beginning with tuition and fees charged for the 2013 fall semester. |
|
Tuition and fees charged for a term or semester before the 2013 fall |
|
semester are covered by the law in effect immediately before the |
|
effective date of this Act, and the former law is continued in |
|
effect for that purpose. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2013. |
