A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to notice provided to certain local officials regarding |
|
|
the use of land application to treat and dispose of certain oil and |
|
|
gas waste. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter D, Chapter 91, Natural Resources |
|
|
Code, is amended by adding Section 91.118 to read as follows: |
|
|
Sec. 91.118. NOTIFICATION OF LAND APPLICATION OF CERTAIN |
|
|
WASTE. If the commission adopts rules requiring a permit to use |
|
|
land application to treat and dispose of oil field fluids or oil and |
|
|
gas wastes, the commission by rule shall require a person who files |
|
|
an application for a permit to provide written notice to: |
|
|
(1) each groundwater conservation district in the area |
|
|
in which the land application will occur; |
|
|
(2) the mayor of each municipality in the area in which |
|
|
the land application will occur; and |
|
|
(3) the county judge of each county in the area in |
|
|
which the land application will occur. |
|
|
SECTION 2. Section 91.118, Natural Resources Code, as added |
|
|
by this Act, applies only to an application for a permit to use land |
|
|
application to treat and dispose of oil field fluids or oil and gas |
|
|
wastes that is filed with the Railroad Commission of Texas on or |
|
|
after the effective date of this Act. An application for a permit |
|
|
that was filed with the commission before the effective date of this |
|
|
Act is governed by the law as it existed on the date the application |
|
|
was filed, and that law is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2011. |
