A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to insurance adjuster license application procedures. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 4101.052, Insurance Code, is amended by |
|
amending Subsection (a) and adding Subsections (c) and (d) to read |
|
as follows: |
|
(a) Except as provided by Subsection (c), an [An] applicant |
|
for a license under this chapter must submit to the department an |
|
application on a form prescribed and provided by the department, |
|
and include as part of or in connection with the application any |
|
information that the department reasonably requires, including |
|
information about the applicant's: |
|
(1) identity; |
|
(2) personal history; |
|
(3) experience; and |
|
(4) business record. |
|
(c) For the purpose of Subsection (a), the commissioner |
|
shall allow an individual to apply for a license electronically |
|
using the National Association of Insurance Commissioners Uniform |
|
Application for Individual Adjuster or Apprentice |
|
License/Registration as it existed on May 1, 2023. |
|
(d) The commissioner shall take any action necessary for |
|
this state to participate in and adopt the application procedures |
|
of the National Association of Insurance Commissioners National |
|
Insurance Producer Registry for the purpose of licensing and |
|
license renewal for independent adjusters. |
|
SECTION 2. Not later than September 1, 2024, the |
|
commissioner of insurance shall adopt rules to implement Section |
|
4101.052(d), Insurance Code, as added by this Act. |
|
SECTION 3. This Act takes effect September 1, 2023. |
