relating to prohibited requests for or disclosures of information | ||
regarding certain child-care facility license holders' ownership, | ||
possession, use, or storage of a firearm or other weapon; creating a | ||
criminal offense. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter C, Chapter 42, Human Resources Code, | ||
is amended by adding Section 42.04413 to read as follows: | ||
Sec. 42.04413. PROHIBITION ON OBTAINING FIREARM | ||
INFORMATION. (a) This section applies to a person: | ||
(1) who holds a license, registration, or | ||
certification under this chapter; or | ||
(2) who applies for a license, registration, or | ||
certification under this chapter. | ||
(b) The department may not request, collect, compile, or | ||
disclose information regarding the lawful ownership, possession, | ||
use, or storage of a firearm or other weapon by a person described | ||
by Subsection (a). | ||
(c) A person who violates Subsection (b) commits an offense. | ||
An offense under this section is a Class C misdemeanor. | ||
SECTION 2. This Act takes effect September 1, 2017. |
