| possession, use, or storage of a firearm or other weapon; creating a | ||
| criminal offense. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter C, Chapter 42, Human Resources Code, | ||
| is amended by adding Section 42.04413 to read as follows: | ||
| Sec. 42.04413. PROHIBITION ON OBTAINING FIREARM | ||
| INFORMATION. (a) This section applies to a person: | ||
| (1) who holds a license, registration, or | ||
| certification under this chapter; or | ||
| (2) who applies for a license, registration, or | ||
| certification under this chapter. | ||
| (b) The department may not request, collect, compile, or | ||
| disclose information regarding the lawful ownership, possession, | ||
| use, or storage of a firearm or other weapon by a person described | ||
| by Subsection (a). | ||
| (c) A person who violates Subsection (b) commits an offense. | ||
| An offense under this section is a Class C misdemeanor. | ||
| SECTION 2. This Act takes effect September 1, 2017. | ||
