A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a requirement that certain persons convicted of the |
|
|
offense of using a wireless communications device while operating a |
|
|
motor vehicle, motorcycle, or moped be allowed to perform community |
|
|
service. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 545.424, Transportation Code, is amended |
|
|
by adding Subsection (g) to read as follows: |
|
|
(g) A court, if the court is located in a municipality or |
|
|
county that has established a community service program, shall |
|
|
allow a person who commits an offense under Subsection (a) or (b) to |
|
|
discharge all or part of the fine or costs associated with the |
|
|
offense by performing community service in the manner provided by |
|
|
Article 45.0492, Code of Criminal Procedure, as added by Chapters |
|
|
227 (H.B. 350) and 777 (H.B. 1964), Acts of the 82nd Legislature, |
|
|
Regular Session, 2011, regardless of the age of the person at the |
|
|
time of the commission of the offense. |
|
|
SECTION 2. This Act takes effect September 1, 2015. |
