required assessments of public school students for certain | ||
purposes. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter B, Chapter 39, Education Code, is | ||
amended by adding Section 39.02342 to read as follows: | ||
Sec. 39.02342. ALTERNATIVE ADMINISTRATION OF ASSESSMENT | ||
INSTRUMENTS BY STUDENT REQUEST. A school district may administer | ||
an assessment instrument required under Section 39.023(a), (c), or | ||
(l) in paper format to any student whose parent or guardian requests | ||
the assessment instrument in paper format, not to exceed a total of | ||
three percent of the students enrolled in a district. An assessment | ||
instrument administered under this section shall not be included in | ||
a school district evaluation under Section 39.053(c). | ||
SECTION 2. This Act applies beginning with the 2023-2024 | ||
school year. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2023. |
