A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the provision of municipal services to a property in the |
|
|
extraterritorial jurisdiction of a municipality following the |
|
|
municipality's denial or refusal to permit an activity or structure |
|
|
on the property. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter Z, Chapter 42, Local Government Code, |
|
|
is amended by adding Section 42.905 to read as follows: |
|
|
Sec. 42.905. PROVISION OF MUNICIPAL SERVICES IN |
|
|
EXTRATERRITORIAL JURISDICTION UNDER CERTAIN CIRCUMSTANCES. A |
|
|
municipality that extends to its extraterritorial jurisdiction the |
|
|
application of a municipal ordinance or rule and denies or refuses |
|
|
to permit an activity or structure on a property in that area under |
|
|
the ordinance or rule shall provide to the property the municipal |
|
|
services described by Section 43.056(b) not later than 30 months |
|
|
after the date of the denial or refusal. |
|
|
SECTION 2. This Act takes effect September 1, 2023. |
