| relating to the sale of dogs or cats for a for-profit business. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Sections 802.003(a) and (b), Occupations Code, | ||
| are amended to read as follows: | ||
| (a) Except as provided by Section 802.0031, this [ |
||
| chapter does not affect the applicability of any other law, rule, | ||
| order, ordinance, or other legal requirement of the federal | ||
| government, this state, or a political subdivision of this state. | ||
| (b) Except as provided by Section 802.0031, this [ |
||
| chapter does not prevent a municipality or county from prohibiting | ||
| or further regulating by order or ordinance the possession, | ||
| breeding, or selling of dogs or cats. | ||
| SECTION 2. Subchapter A, Chapter 802, Occupations Code, is | ||
| amended by adding Section 802.0031 to read as follows: | ||
| Sec. 802.0031. SALE OF DOG OR CAT BY FOR-PROFIT BUSINESS; | ||
| PREEMPTION. A municipality or county may not adopt or enforce an | ||
| ordinance, order, regulation, or similar measure that prohibits the | ||
| sale of a dog or cat by a for-profit business otherwise in | ||
| compliance with state law. | ||
| SECTION 3. This Act takes effect September 1, 2023. | ||
