A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to applications for certain alcoholic beverage permits and |
|
|
licenses. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 11.46, Alcoholic Beverage Code, is |
|
|
amended by adding Subsection (e) to read as follows: |
|
|
(e) The commission or administrator shall refuse to issue an |
|
|
original permit authorizing the retail sale of alcoholic beverages |
|
|
to an applicant who has been refused the same type of permit for the |
|
|
same premises three or more times. |
|
|
SECTION 2. Section 61.42, Alcoholic Beverage Code, is |
|
|
amended by adding Subsection (e) to read as follows: |
|
|
(e) The county judge, commission, or administrator shall |
|
|
refuse to approve or issue an original license authorizing the |
|
|
retail sale of alcoholic beverages to an applicant who has been |
|
|
refused the same type of license for the same premises three or more |
|
|
times. |
|
|
SECTION 3. The changes in law made by this Act apply only |
|
|
with respect to an original alcoholic beverage permit or license |
|
|
application made on or after the effective date of this Act. |
|
|
SECTION 4. This Act takes effect September 1, 2017. |
