A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the sources of supply of water for certain municipally |
|
owned water utilities. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter B, Chapter 552, Local Government |
|
Code, is amended by adding Section 552.025 to read as follows: |
|
Sec. 552.025. MULTIPLE SOURCES OF SUPPLY FOR CERTAIN |
|
MUNICIPALLY OWNED UTILITIES. (a) In this section, "municipally |
|
owned utility" and "utility" have the meanings assigned by Section |
|
13.002, Water Code. |
|
(b) This section applies only to a municipally owned utility |
|
that serves: |
|
(1) a municipality with a population of more than |
|
500,000; and |
|
(2) offices or other facilities of a state agency. |
|
(c) A municipally owned utility shall have at least two |
|
sources of water supply available to the utility for the purposes of |
|
the provision of its services. |
|
(d) A municipally owned utility that on the effective date |
|
of this section is not in compliance with the requirement of |
|
Subsection (c) immediately shall acquire, develop, or contract for |
|
one or more alternative sources of water for the provision of its |
|
services so that the utility meets that requirement before |
|
September 1, 2023. This subsection expires September 1, 2025. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2019. |
