relating to the referral of certain students receiving special | ||
education services to a local intellectual and developmental | ||
disability authority for services or public benefits. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter A, Chapter 29, Education Code, is | ||
amended by adding Section 29.025 to read as follows: | ||
Sec. 29.025. REFERRAL TO LOCAL INTELLECTUAL AND | ||
DEVELOPMENTAL DISABILITY AUTHORITY. A school district shall refer | ||
each student receiving special education services under this | ||
subchapter who has or is suspected to have an intellectual or | ||
developmental disability to a local intellectual and developmental | ||
disability authority for services or public benefits, including | ||
services under a Medicaid waiver program established under Section | ||
1915(c), Social Security Act (42 U.S.C. Section 1396n(c)). | ||
SECTION 2. This Act applies beginning with the 2023-2024 | ||
school year. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2023. |
