A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the creation of a waste tire dumping enforcement grant |
|
program; authorizing a fee. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 361, Health and Safety Code, is amended |
|
by adding Subchapter P to read as follows: |
|
SUBCHAPTER P. WASTE TIRE DUMPING ENFORCEMENT GRANT PROGRAM |
|
Sec. 361.471. DEFINITIONS. In this subchapter, "used tire" |
|
means a tire that: |
|
(1) has been used as a tire on a vehicle; and |
|
(2) can still be used for its original intended |
|
purpose. |
|
Sec. 361.472. COLLECTION OF FEE ON SALE OF TIRE. (a) A |
|
seller shall collect a fee in an amount to be determined by the |
|
commission on the sale of each new or used tire. |
|
(b) On a schedule determined by the commission, a seller |
|
shall remit fees collected under Subsection (a) to the comptroller |
|
for deposit into an account in the general revenue fund to be used |
|
to fund the grant program under Section 361.473. |
|
Sec. 361.473. GRANT PROGRAM. The commission shall develop |
|
and implement a program to provide grants to local law enforcement |
|
agencies to assist those agencies in the enforcement of laws |
|
related to the illegal dumping of tires. |
|
SECTION 2. This Act takes effect September 1, 2017. |
