relating to certain restrictions on package store permit holders. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 22.06(a), Alcoholic Beverage Code, is | ||
amended to read as follows: | ||
(a) Except as otherwise provided in Section 102.05, no | ||
person who holds a package store permit or owns an interest in a | ||
package store may have a direct or indirect interest in any of the | ||
following: | ||
(1) a brewer's [ |

general or branch distributor's license; | ||
(2) a [ |
||
(3) the business of any of the permits or licenses | ||
listed in Subdivisions (1) and (2) of this subsection. | ||
SECTION 2. Section 22.14(d), Alcoholic Beverage Code, is | ||
amended to read as follows: | ||
(d) Subsections (a), (b), and (c) shall not apply to a | ||
package store that: | ||
(1) qualifies for exemption under Section 11.50; | ||
(2) is adjacent [ |
||
covered by a wine only package store permit, wine and malt beverage | ||
retailer's permit, or wine and malt beverage retailer's off-premise | ||
permit operated by the package store permit holder; or | ||
(3) is located in a hotel that qualifies for exemption | ||
under Section 102.05. | ||
SECTION 3. Section 22.16, Alcoholic Beverage Code, is | ||
repealed. | ||
SECTION 4. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2023. |
