A BILL TO BE ENTITLED
 
AN ACT
  relating to certain restrictions on package store permit holders.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 22.06(a), Alcoholic Beverage Code, is
  amended to read as follows:
         (a)  Except as otherwise provided in Section 102.05, no
  person who holds a package store permit or owns an interest in a
  package store may have a direct or indirect interest in any of the
  following:
               (1)  a brewer's [, retail dealer's on-premise,] or
  general or branch distributor's license;
               (2)  a [wine and malt beverage retailer's, wine and malt
  beverage retailer's off-premise, or] mixed beverage permit; or
               (3)  the business of any of the permits or licenses
  listed in Subdivisions (1) and (2) of this subsection.
         SECTION 2.  Section 22.14(d), Alcoholic Beverage Code, is
  amended to read as follows:
         (d)  Subsections (a), (b), and (c) shall not apply to a
  package store that:
               (1)  qualifies for exemption under Section 11.50;
               (2)  is adjacent [or] to the premises of a business
  covered by a wine only package store permit, wine and malt beverage
  retailer's permit, or wine and malt beverage retailer's off-premise
  permit operated by the package store permit holder; or
               (3)  is located in a hotel that qualifies for exemption
  under Section 102.05.
         SECTION 3.  Section 22.16, Alcoholic Beverage Code, is
  repealed.
         SECTION 4.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2023.
