A BILL TO BE ENTITLED
|
|
AN ACT
|
|
|
relating to standing in a roadway; amending provisions subject to a |
|
criminal penalty. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. The heading to Section 552.007, Transportation |
|
Code, is amended to read as follows: |
|
Sec. 552.007. [SOLICITATION BY] PEDESTRIANS IN ROADWAY. |
|
SECTION 2. Section 552.007(a), Transportation Code, is |
|
amended to read as follows: |
|
(a) A person may not stand in a roadway in a manner that |
|
impedes vehicular traffic or presents a danger to the person or |
|
another person unless [to solicit a ride, contribution, employment,
|
|
or business from an occupant of a vehicle, except that a person may
|
|
stand in a roadway to solicit a charitable contribution if] |
|
authorized to do so by the local authority having jurisdiction over |
|
the roadway. |
|
SECTION 3. Sections 552.006(b), 552.007(b) and (c), and |
|
552.0071, Transportation Code, are repealed. |
|
SECTION 4. The changes in law made by this Act apply only to |
|
an offense committed on or after the effective date of this Act. An |
|
offense committed before the effective date of this Act is governed |
|
by the law in effect on the date the offense was committed, and the |
|
former law is continued in effect for that purpose. For purposes of |
|
this section, an offense was committed before the effective date of |
|
this Act if any element of the offense occurred before that date. |
|
SECTION 5. This Act takes effect September 1, 2017. |
