A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to sunset review of certain municipal management |
|
|
districts. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 375, Local Government |
|
|
Code, is amended by adding Section 375.005 to read as follows: |
|
|
Sec. 375.005. SUNSET REVIEW OF MUNICIPAL MANAGEMENT |
|
|
DISTRICTS IN CERTAIN COUNTIES. (a) A municipal management or other |
|
|
district to which this chapter applies or that incorporates a power |
|
|
provided by this chapter is subject to review under Chapter 325, |
|
|
Government Code (Texas Sunset Act), as if it were a state agency |
|
|
subject to review under that chapter but may not be abolished under |
|
|
that chapter without further legislative action. |
|
|
(b) A district shall be reviewed as if the district were |
|
|
scheduled to be abolished on September 1 of the eighth year after |
|
|
the date the bill creating the district was enacted. |
|
|
(c) This section applies only to a district located in a |
|
|
county with a population of 3.3 million or more. |
|
|
(d) A district shall pay the cost incurred by the Sunset |
|
|
Advisory Commission in performing a review of the district under |
|
|
this section. The Sunset Advisory Commission shall determine the |
|
|
cost, and the district shall pay the amount promptly on receipt of a |
|
|
statement from the Sunset Advisory Commission detailing the cost. |
|
|
SECTION 2. Section 375.005, Local Government Code, as added |
|
|
by this Act, applies only to a district created on or after the |
|
|
effective date of this Act. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2013. |
