A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to disclosure of financial studies and reports associated |
|
|
with a toll project. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 372, Transportation Code, |
|
|
is amended by adding Section 372.002 to read as follows: |
|
|
Sec. 372.002. FINANCIAL STUDIES AND REPORTS SUBJECT TO |
|
|
DISCLOSURE. (a) Financial studies and reports associated with a |
|
|
toll project, including financial forecasts and traffic and revenue |
|
|
reports, are subject to disclosure, inspection, and copying under |
|
|
Chapter 552, Government Code. |
|
|
(b) Notwithstanding Sections 223.204(a), 366.403(a), and |
|
|
370.307(a), this section applies to financial studies and reports |
|
|
associated with a proposed toll project, regardless of whether a |
|
|
final contract for the project has been entered into. |
|
|
SECTION 2. Section 371.052(d), Transportation Code, is |
|
|
repealed. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2017. |
