A JOINT RESOLUTION
  proposing a constitutional amendment to prevent certain public
  officers and entities from prohibiting the operation of industries
  or other categories of business or commercial activity in this
  state.
         BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Article I, Texas Constitution, is amended by
  adding Section 35 to read as follows:
         Sec. 35.  An agency or officer of the executive department of
  this state, a political subdivision of this state, or an officer of
  a political subdivision of this state may not prohibit the
  operation of an industry or other category of business or
  commercial activity otherwise legally operating in this state.
         SECTION 2.  This proposed constitutional amendment shall be
  submitted to the voters at an election to be held November 2, 2021.
  The ballot shall be printed to permit voting for or against the
  proposition: "The constitutional amendment to prevent an agency or
  officer of the executive department of this state, a political
  subdivision of this state, or an officer of a political subdivision
  of this state from prohibiting the operation of a legally operating
  industry or other category of business or commercial activity in
  this state."
