| BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Article I, Texas Constitution, is amended by | ||
| adding Section 35 to read as follows: | ||
| Sec. 35. An agency or officer of the executive department of | ||
| this state, a political subdivision of this state, or an officer of | ||
| a political subdivision of this state may not prohibit the | ||
| operation of an industry or other category of business or | ||
| commercial activity otherwise legally operating in this state. | ||
| SECTION 2. This proposed constitutional amendment shall be | ||
| submitted to the voters at an election to be held November 2, 2021. | ||
| The ballot shall be printed to permit voting for or against the | ||
| proposition: "The constitutional amendment to prevent an agency or | ||
| officer of the executive department of this state, a political | ||
| subdivision of this state, or an officer of a political subdivision | ||
| of this state from prohibiting the operation of a legally operating | ||
| industry or other category of business or commercial activity in | ||
| this state." | ||
