A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to increasing the criminal penalty for the offense of |
|
|
injury to a child, elderly individual, or disabled individual when |
|
|
committed in a disaster area or evacuated area. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 12.50(b), Penal Code, is amended to read |
|
|
as follows: |
|
|
(b) The increase in punishment authorized by this section |
|
|
applies only to an offense under: |
|
|
(1) Section 20.05; |
|
|
(2) Section 20.06; |
|
|
(3) Section 20.07; |
|
|
(4) Section 22.01; |
|
|
(5) Section 22.04; |
|
|
(6) [(5)] Section 28.02; |
|
|
(7) [(6)] Section 29.02; |
|
|
(8) [(7)] Section 30.02; |
|
|
(9) [(8)] Section 30.03; |
|
|
(10) [(9)] Section 30.04; |
|
|
(11) [(10)] Section 30.05; and |
|
|
(12) [(11)] Section 31.03. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to an offense committed on or after the effective date of this Act. |
|
|
An offense committed before the effective date of this Act is |
|
|
governed by the law in effect on the date the offense was committed, |
|
|
and the former law is continued in effect for that purpose. For |
|
|
purposes of this section, an offense was committed before the |
|
|
effective date of this Act if any element of the offense occurred |
|
|
before that date. |

|
SECTION 3. This Act takes effect September 1, 2025. |
