A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to reimbursement for services provided by advanced |
|
practice nurses and physician assistants under the Medicaid |
|
program. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter B, Chapter 32, Human Resources Code, |
|
is amended by adding Section 32.0426 to read as follows: |
|
Sec. 32.0426. REIMBURSEMENT FOR SERVICES PROVIDED BY |
|
ADVANCED PRACTICE NURSES AND PHYSICIAN ASSISTANTS. (a) In this |
|
section: |
|
(1) "Advanced practice nurse" has the meaning assigned |
|
by Section 301.152, Occupations Code. |
|
(2) "National provider identifier" means the national |
|
provider identifier required under Section 1128J(e), Social |
|
Security Act (42 U.S.C. Section 1320a-7k(e)). |
|
(3) "Physician assistant" means a person who holds a |
|
license issued under Chapter 204, Occupations Code. |
|
(b) If an advanced practice nurse or a physician assistant |
|
provides a service to a recipient under the medical assistance |
|
program at the direction or under the supervision of another |
|
provider and the advanced practice nurse or physician assistant, as |
|
applicable, is the primary provider of the service: |
|
(1) the name and associated national provider |
|
identifier of the advanced practice nurse or physician assistant, |
|
as applicable, must be included as the rendering provider on any |
|
claim for reimbursement submitted by a provider; and |
|
(2) the department may reimburse the claim only at the |
|
provider level established by rule for an advanced practice nurse |
|
or physician assistant, as applicable. |
|
(c) The executive commissioner of the Health and Human |
|
Services Commission may adopt rules necessary to implement this |
|
section. |
|
SECTION 2. If before implementing any provision of this Act |
|
a state agency determines that a waiver or authorization from a |
|
federal agency is necessary for implementation of that provision, |
|
the agency affected by the provision shall request the waiver or |
|
authorization and may delay implementing that provision until the |
|
waiver or authorization is granted. |
|
SECTION 3. This Act takes effect September 1, 2013. |
