A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the inclusion in a toll project construction plan of a |
|
|
plan for the construction of adjacent nontolled lanes. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 372, Transportation Code, |
|
|
is amended by adding Section 372.003 to read as follows: |
|
|
Sec. 372.003. ADJACENT NONTOLLED LANES REQUIRED. (a) The |
|
|
governing body of a toll project entity may not: |
|
|
(1) adopt a plan for the construction of a toll project |
|
|
unless the plan includes a plan for the construction of at least one |
|
|
adjacent nontolled lane of travel in each direction; or |
|
|
(2) authorize the collection of a toll for the use of a |
|
|
toll project in a plan described by Subdivision (1) until the |
|
|
planned nontolled lanes are open to traffic. |
|
|
(b) This section does apply to a department toll facility |
|
|
designation under Section 228.201(a)(3) or (4). |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to a toll project for which an initial plan is adopted on or after |
|
|
September 1, 2021. |
|
|
SECTION 3. This Act takes effect September 1, 2021. |
