Effect this measure will have on costs and revenues of state government.
HB5090 would increase the amount of civil administrative penalties that could be assessed on larger individual or general contruction stormwater WV/National Pollutant Discharge Elimination System (NPDES) permitees that have the potential for repetitive violations or violations that could occur on a significantly larger scale. Expenditures would not be expected to increase with the implementation of this bill, however revenues would be expected to increase due to the added multiplying factors on the penalties.

It's estimated that HB5090 could generate an an additional $500,000 and potentially more, depending upon the size of the sites that end up being penalized. There would be no increase in expenditures since this bill does not create responsibilities that impose additional operating costs.
