A BILL to repeal §16-5Y-12 of the Code of West Virginia, 1931, as amended; and to amend said code by adding thereto a new section, designated §16-5Y-14, all relating to removing the moratorium on medication-assisted facilities, and providing a cap on the number of medication-assisted facilities in West Virginia.

Be it enacted by the Legislature of West Virginia:

ARTICLE 5Y. MEDICATION-ASSISTED TREATMENT PROGRAM LICENSING ACT.

§16-5Y-12. Moratorium; certificate of need.

[Repealed].

§16-5Y-14. Limitations on number of MAT facilities per county.

The number of medication-assisted facilities shall be capped at a maximum amount of 20 for the state, with a limit of one facility per county in West Virginia. Those facilities existing in the highest area of need shall have priority as to the number of facilities in this state.

NOTE: The purpose of this bill is to remove the moratorium on medication-assisted facilities. The bill also provides a cap on the number of medication-assisted facilities in West Virginia.
