AN ACT
amending section 15‑1808, Arizona Revised Statutes; repealing section 41‑1861, Arizona Revised Statutes; amending title 41, chapter 12.1, article 3, Arizona Revised Statutes, by adding a new section 41‑1861; amending sections 41‑1862 and 41‑1863, Arizona revised statutes; amending title 41, chapter 27, article 2, Arizona Revised Statutes, by adding section 41‑3027.01; relating to the fallen firefighter memorial.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Section 15-1808, Arizona Revised Statutes, is amended to read:
15-1808. Tuition waiver for child or spouse of peace officer, correctional officer, firefighter, emergency paramedic, national guard member or member of the United States armed forces killed in the line of duty; national guard members with disabilities; United States armed forces members with disabilities; definitions
A. The Arizona board of regents, after verification by the Arizona peace officers memorial board, by the Arizona fire fighters and emergency paramedics memorial board fallen firefighter memorial committee, by the adjutant general of the national guard or by the Arizona department of veterans' services that a person is a child or a spouse of a peace officer, correctional officer, fire fighter firefighter, emergency paramedic, national guard member or member of the United States armed forces who was a resident of the state of Arizona or stationed in Arizona and who was killed in the line of duty or who died from injuries suffered in the line of duty while traveling to or from duty, shall provide the person who qualifies under subsection B of this section and who otherwise meets the qualifications for admission with a tuition waiver scholarship at any university under the jurisdiction of the board. A district as defined in section 15‑1401, after verification by the Arizona peace officers memorial board, by the Arizona fire fighters and emergency paramedics memorial board fallen firefighter memorial committee, by the adjutant general of the national guard or by the Arizona department of veterans' services that a person is the child or the spouse of a peace officer, correctional officer, firefighter, emergency paramedic, national guard member or member of the United States armed forces who was a resident of Arizona or stationed in Arizona and who was killed in the line of duty or who died from injuries suffered in the line of duty while traveling to or from duty, shall provide the person who qualifies under subsection B of this section and who otherwise meets the qualifications for admission with a tuition waiver scholarship at any community college under the jurisdiction of the district.
B. The tuition waiver scholarships shall be limited to children who are thirty years of age or younger or a spouse who has not remarried and shall be limited for a spouse or for any one child to no not more than sixty‑four credit hours at Arizona community colleges and a total number of credits including any transfer credits from an Arizona community college equal to the number of credits required for a baccalaureate degree at Arizona universities for that student's initially declared course of study.
C. A member of the Arizona national guard who received a purple heart citation on or after September 11, 2001 or a former member of the Arizona national guard who was medically discharged from the Arizona national guard due to an injury or disability suffered during status under title 10, United States Code, in weekend training status, in annual training status or in response to a state of emergency declared by the governor is eligible for a tuition waiver scholarship provided for in this section.
D. The Arizona board of regents, after verification by the Arizona department of veterans' services that a person is a member or former member of the United States armed forces who received a purple heart citation, who was a resident of the state of Arizona or was stationed in Arizona at the time of the injury that resulted in the purple heart citation and whose disability rating determined by the United States department of veterans affairs is fifty per cent percent or more, shall provide the person who otherwise meets the qualifications for admission with a tuition waiver scholarship at any university under the jurisdiction of the board. A district as defined in section 15‑1401, after verification by the Arizona department of veterans' services that a person is a member or former member of the United States armed forces who received a purple heart citation, who was a resident of the state of Arizona or was stationed in Arizona at the time of the injury that resulted in the purple heart citation and whose disability rating determined by the United States department of veterans affairs is fifty per cent percent or more, shall provide the person who otherwise meets the qualifications for admission with a tuition waiver scholarship at any community college under the jurisdiction of the district. A person who is convicted of a felony is ineligible for a tuition waiver scholarship provided for in this subsection.
E. For the purposes of this section:
1. "Correctional officer" means a person, other than an elected official, who is employed by this state or a county, city or town and who is responsible for the supervision, protection, care, custody or control of inmates in a state, county or municipal correctional institution, including counselors but excluding secretarial, clerical and professionally trained personnel.
2. "Emergency paramedic" means a person who has been trained in an emergency paramedic training program certified by the director of the department of health services or in an equivalent training program and who is certified by the director of the department of health services to render services pursuant to section 36‑2205.
3. "Firefighter" means a professional firefighter who is a member of a state, federal, tribal, city, county, district or private fire department.
4. "Peace officers" means sheriffs of counties, constables, marshals, police officers of cities and towns, commissioned personnel of the department of public safety and police officers appointed by community college district governing boards or the Arizona board of regents who have received a certificate from the Arizona peace officer standards and training board, and other state, federal, tribal, city or county officers vested by law with a duty to maintain public order and make arrests.
Sec. 2. Heading change
The article heading of title 41, chapter 12.1, article 3, Arizona Revised Statutes, is changed from "fire fighters and emergency paramedics memorial" to "Arizona fallen firefighter memorial".
Sec. 3. Repeal
Section 41-1861, Arizona Revised Statutes, is repealed.
Sec. 4. Title 41, chapter 12.1, article 3, Arizona Revised Statutes, is amended by adding a new section 41-1861, to read:
41-1861. Arizona fallen firefighter memorial committee; membership
A. The ARizona fallen firefighter memorial committee is established consisting of the following members:
1. The president of this state's largest professional firefighters organization who shall serve as the chairperson of the committee.
2. One public member who is appointed by the chairperson of the committee.
3. The state forester or the state forester's designee.
4. The director of the historical advisory commission or the director's designee.
5. The director of the department of administration or the director's designee.
6. The commander of a professional firefighters organization honor guard.
7. The president of the Arizona fire chiefs association.
8. Two public members who are appointed by the governor.
B. Members of the committee are not eligible to receive compensation, but members are entitled to reimbursement from the Arizona fallen firefighter memorial fund established by section 41‑1863 for reasonable expenses in traveling on and attending to official committee business.
Sec. 5. Section 41-1862, Arizona Revised Statutes, is amended to read:
41-1862. Arizona fallen firefighter memorial committee; powers and duties; subcommittee
A. The Arizona fire fighters and emergency paramedics memorial board fallen firefighter memorial committee shall:
1. Establish a memorial for all fire fighters and emergency paramedics who have lost their lives in the line of duty.
1. Establish an acceptable set of standards for persons to be memorialized on the Arizona fallen firefighter memorial that is located in Wesley Bolin plaza.
2. Determine those persons who are eligible to be memorialized.
3. Plan and provide for additions to and maintenance of the fire fighters and emergency paramedics Arizona fallen firefighter memorial on an annual basis.
4. Solicit private monetary donations or public monies from municipalities for deposit in the Arizona fire fighters and emergency paramedics fallen firefighter memorial fund.
5. Receive property from any public source for use in establishing or maintaining the memorial.
6. Report annually to the president of the senate and the speaker of the house of representatives on the progress of the memorial and shall provide a copy of this report to the secretary of state and the director of the Arizona state library, archives and public records.
5. Conduct an ANNUAL fallen firefighter memorial service.
7. 6. Determine those persons who are eligible for the tuition waiver scholarship pursuant to section 15‑1808 and report the determination to the governor's office and Arizona board of regents or to each community college district governing board, as applicable.
B. The committee may establish a subcommittee that is appointed by the committee chairperson to receive applications from and recommend tuition waiver scholarships for persons who are eligible for the tuition waiver scholarship pursuant to section 15‑1808. The subcommittee shall forward any recommendation for a tuition waiver scholarship to the committee for approval.
C. The committee shall meet every January and may. The committee may conduct additional meetings in person or telephonically.
Sec. 6. Section 41-1863, Arizona Revised Statutes, is amended to read:
41-1863. Arizona fallen firefighter memorial fund
A. An the Arizona fire fighters and emergency paramedics fallen firefighter memorial fund is established. The fund shall consist of monies received as donations as provided for in this article. On notice from the board committee, the state treasurer shall invest and divest monies in the Arizona fire fighters and emergency paramedics fallen firefighter memorial fund as provided by section 35‑313, and monies earned from investment shall be credited to the fund. The monies in the fund are exempt from section 35‑190, relating to lapsing of appropriations.
B. The state treasurer shall pay the costs and expenses authorized by this article from the monies available in the Arizona fire fighters and emergency paramedics fallen firefighter memorial fund on certification to the state treasurer by the chairman chairperson of the Arizona fire fighters and emergency paramedics memorial board fallen firefighter memorial committee that the amount requested is owed for a valid purpose.
Sec. 7. Title 41, chapter 27, article 2, Arizona Revised Statutes, is amended by adding section 41-3027.01, to read:
41-3027.01. Arizona fallen firefighter memorial committee; termination July 1, 2027
A. The Arizona fallen firefighter memorial committee terminates on July 1, 2027.
B. Title 41, chapter 12.1, article 3 and this section are repealed on January 1, 2028.
Sec. 8. Purpose
Pursuant to section 41‑2955, subsection E, Arizona Revised Statutes, the legislature establishes the Arizona fallen firefighter memorial committee to memorialize fallen firefighters and determine those persons who are eligible for tuition waiver scholarships pursuant to section 15‑1808, Arizona Revised Statutes.
