AN ACT
Prescribing the adoption of department of health services rules relating to campgrounds.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Department of health services; primitive camping and picnic grounds; rules; exemption; delayed repeal
A. On or before July 1, 2017, the department of health services shall adopt rules regarding primitive camping and picnic grounds for the purposes of allowing access to hiking, camping, park and picnic areas located in primitive and remote settings that do both the following:
1. Define primitive camping and picnic grounds.
2. Provide for exemptions that would be determined on a case‑by‑case basis by a county health department from rules relating to water supply, sewage and refuse disposal and toilets for primitive camping and picnic grounds with the intent to allow access to remote settings with limited readily-accessible public infrastructure available.
B. For the purposes of this act, the department is exempt from the rulemaking requirements of title 41, chapter 6, Arizona Revised Statutes, until July 1, 2017, except that the department shall provide public notice and an opportunity for public comment on proposed rules at least thirty days before a rule is adopted or amended.
C. This section is repealed from and after July 1, 2018.
