AN ACT
amending section 28‑1444, Arizona Revised Statutes; relating to driving under the influence.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Section 28-1444, Arizona Revised Statutes, is amended to read:
28-1444. Reimbursement of incarceration costs; municipal court assessment
A. The court shall order a person who is sentenced to a term of incarceration for a violation of this chapter to reimburse the political subdivision that is responsible for the costs of the person's incarceration for those incarceration costs.
B. The court may determine the amount of incarceration costs to be paid based on the following factors:
1. The per diem per person cost of incarceration incurred by the political subdivision that incarcerates the person.
2. The person's ability to pay part or all of the incarceration costs.
C. If the person is convicted in a municipal court of a violation of an offense included in article 3 of this chapter and the court does not order the person to reimburse the political subdivision for incarceration costs pursuant to subsection A of this section, the city or town council of the city or town in which the municipal court is located may impose an assessment on the person not to exceed three hundred dollars. The city or town shall use the assessed monies to defray incarceration costs.
