AN ACT
amending section 25-101, Arizona Revised Statutes; relating to marriage.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Section 25-101, Arizona Revised Statutes, is amended to read:
25-101. Void and prohibited marriages
A. Marriage between parents and children, including grandparents and grandchildren of every degree, between brothers and sisters siblings of the one‑half as well as the whole blood, and between uncles and nieces or nephews, between aunts and nieces or nephews and between first cousins, is prohibited and void.
B. Notwithstanding
subsection A of this section,
first cousins may marry if both are sixty‑five years of age or older or
if one or both first cousins are under sixty‑five years of age, upon on
approval of any superior court judge in the state if proof has been
presented to the judge that one of the cousins is unable to reproduce.
C. Marriage
between persons of the same sex is void and prohibited.
Sec. 2. Conditional enactment
This act does not become effective unless the Constitution of Arizona is amended by vote of the people at the next general election to remove the constitutional prohibition relating to marriage equality.
