HOUSE BILL 2123

 

 

AN ACT

 

Establishing the transaction privilege tax reform committee.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Transaction privilege tax reform committee; report; delayed repeal

A.  The transaction privilege tax reform committee is established consisting of:

1.  Three members of the senate who are appointed by the president of the senate, not more than two of whom are members of the same political party.  The president of the senate shall designate one member as cochairperson.

2.  Three members of the house of representatives who are appointed by the speaker of the house of representatives, not more than two of whom are members of the same political party. The speaker of the house of representatives shall designate one member as cochairperson.

3.  The director of the department of revenue.

4.  Two members who represent cities and towns, one who is appointed by the president of the senate and one who is appointed by the speaker of the house of representatives.

5.  One member who represents counties and who is appointed by the speaker of the house of representatives.

6.  One member who represents a taxpayer organization in this state and who is appointed by the president of the senate.

7.  One member who represents a small business in this state and who is appointed by the speaker of the house of representatives.

8.  One member who represents a corporate business in this state and who is appointed by the president of the senate.

B.  The committee shall:

1.  Study and make recommendations regarding the collection of revenues to the state general fund including:

(a)  Individual and corporate income tax.

(b)  Transaction privilege tax.

2.  Make recommendations to minimize the fiscal impact to cities, towns and counties.

3.  Submit a report of the committee's findings and recommendations on or before October 31, 2012 to the governor, the president of the senate and the speaker of the house of representatives and shall provide a copy of the report to the secretary of state.

C.  This section is repealed from and after October 31, 2013.

Sec. 2.  Emergency

This act is an emergency measure that is necessary to preserve the public peace, health or safety and is operative immediately as provided by law.
