AN ACT
amending title 38, chapter 3, ARTICLE 4, Arizona Revised Statutes, by adding section 38‑450; relating to public officers.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 38, chapter 3, article 4, Arizona Revised Statutes, is amended by adding section 38-450, to read:
38-450. Multiracial category required in survey regarding ethnicity
If a state law requires a public officer of an agency of this state or a political subdivision of this state, including school districts, charter schools, community college districts and universities under the jurisdiction of the Arizona board of regents, to specifically determine the ethnicity of groups of people or if the public officer of an agency of this state or a political subdivision of this state determines it is necessary in implementing a program required by law to determine the ethnicity of groups of people, the public officer shall include in the survey that the list of different ethnicities include the category of multiracial.
Sec. 2. Applicability
This act only applies to governmental forms that contain a survey relating to ethnicity and that are created after the effective date of this act. A governmental unit may continue to use existing forms containing a survey relating to ethnicity without the requirements of this act until those forms are depleted.
