AN ACT

 

amending section 3‑518, Arizona Revised Statutes; relating to fruit and vegetable standards.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Section 3-518, Arizona Revised Statutes, is amended to read:

START_STATUTE3-518.  Exempt transactions

This article shall does not prevent:

1.  A producer of fruit or vegetables in the this state from selling or delivering his the producer's products unpacked and unmarked in bulk to a packer in this state for grading, packing or storage.

2.  A producer or packer from manufacturing the products into a by‑product.

3.  A producer from selling the products unpacked or unmarked to a person engaged in the operation of a commercial by‑products factory for the purpose of being used in the manufacture of a by‑product for resale.

4.  A producer or shipper from shipping, transporting or moving melons and vegetables in field bins or bulk out of this state a distance of not more than twenty‑five miles beyond the border of this state into any adjoining state within the United States, if all of the following conditions are met:

(a)  The melons and vegetables are grown in this state and adequate facilities are available in the adjoining state to handle and pack the melons and vegetables in accordance with this article.

(b)  The melons and vegetables are not trimmed or vacuum-cooled in this state before packing.

(c)  the Shipping, transporting or moving is carried out on behalf of the producer or shipper as part of a continuous activity of harvesting, wrapping, packing, processing, cooling, vacuum-cooling, applying controlled atmosphere or otherwise preparing melons and vegetables for shipment and sale in accordance with this article.

(d)  The producer or shipper obtains a permit from the associate director authorizing the shipping, transporting or moving into the adjoining state and complies with the permit requirements, including those requiring inspection in the destination state.  A permit is valid for not more than one hundred eighty days, may be renewed for successive one hundred eighty-day periods and may be canceled for not complying with the requirements specified in the permit.

(e)  The associated director obtains satisfactory verification from the state officials of the destination state that the melons and vegetables will be handled and packed in accordance with the requirements specified in the permit. END_STATUTE
