AN ACT

 

amending title 13, chapter 37, Arizona Revised Statutes, by adding section 13-3730; relating to crimes against first responders.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 13, chapter 37, Arizona Revised Statutes, is amended by adding section 13-3730, to read:

START_STATUTE13-3730.  Offenses committed against peace officers, firefighters or emergency medical services personnel; classification

A.  It is unlawful for any person to select the victim of the following offenses because of the victim's actual or perceived employment as a peace officer, a public or private firefighter or emergency medical services personnel:

1.  First degree murder.

2.  Second degree murder.

3.  Manslaughter.

4.  Assault.

5.  Aggravated assault.

6.  Drive by shooting.

7.  Threatening or intimidating pursuant to section 13‑1202.

8.  Adding poison or other harmful substance to food, drink or medicine pursuant to section 13‑3704.

9.  Sexual assault.

10.  Unlawful imprisonment.

11.  Kidnapping.

12.  Arson of a structure or property.

13.  Arson of an occupied structure.

14.  Criminal damage.

15.  Aggravated criminal damage.

16.  First, second or third degree burglary.

17.  First, second or third degree criminal trespass.

18.  Robbery.

19.  Armed robbery.

20.  Theft.

21.  Theft by extortion.

B.  A violation of this section is a class 4 felony if the underlying offense is a felony.  A violation of this section is a class 1 misdemeanor if the underlying offense is a misdemeanor.  The sentence imposed on a person for a violation of this section shall be consecutive to any other sentence imposed on the person at any time.
