AN ACT
amending title 44, chapter 9, article 6, arizona revised statutes, by adding section 44-1283; relating to telephone solicitations.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 44, chapter 9, article 6, Arizona Revised Statutes, is amended by adding section 44-1283, to read:
44-1283. Cell phone network carrier; spam calls; civil penalty; attorney general; definitions
A. A cell phone network carrier shall prohibit:
1. Spam calls from connecting to any telephone that is located in this state.
2. Any call that originated by using dialer software.
B. The consumer protection division of the attorney general's Office shall create a website that:
1. Allows an individual to report a violation of subsection A of this section that includes how to provide the spam call number and additional information.
2. Allows A resident in this state to submit the resident's telephone number to the Arizona Do Not Call List and that provides the list to each cell phone network carrier on a monthly basis.
C. If a cell phone network carrier is in violation of subsection A of this section, The attorney general shall:
1. For the first violation, provide a written warning.
2. For subsequent violations, impose a $100 civil penalty per spam call. For the purposes of this paragraph, the attorney general's office shall retain $50 of every $100 collected to maintain the consumer protection division.
D. For the purposes of this section:
1. "Cell phone network carrier" means a wireless service provider that provides cellular connectivity to mobile devices.
2. "Dialer software" means a tool that automates the process of making calls to individuals.
