AN ACT

 

Amending title 36, chapter 29, article 1, Arizona Revised Statutes, by adding section 36-2923.01; relating to the Arizona health care cost containment system.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 36, chapter 29, article 1, Arizona Revised Statutes, is amended by adding section 36-2923.01, to read:

START_STATUTE36-2923.01.  Members; employer information; report; public access; definitions

A.  Notwithstanding any other law, each applicant for services pursuant to this chapter and each applicant for redetermination of eligibility shall identify that person's employer and the employer of that person's spouse.  If the applicant is a child, the applicant's parent or responsible party shall identify the parent's or responsible party's employer.

B.  On or before November 15 of each year, the administration shall prepare a report that lists each employer identified pursuant to subsection A, the total number of employees employed by each employer and the total number of those employees and their spouses and dependents who are enrolled pursuant to this article and article 4 of this chapter.  In preparing each report, the administration shall use the most recent data available from the department of economic security.

C.  The administration shall submit this report to the governor, the president of the senate and the speaker of the house of representatives and shall provide a copy of the report to the secretary of state. 

D.  Reports submitted pursuant to this section are public documents.

E.  For the purposes of this section:

1.  "Employee" means a person who is compensated by an employer, whether on a full-time, part-time or seasonal basis.

2.  "Employer" means a business with at least two hundred fifty employees in this state. END_STATUTE
