An Act
amending title 16, chapter 2, article 4, Arizona Revised Statutes, by adding section 16-242.01; relating to the presidential preference election.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 16, chapter 2, article 4, Arizona Revised Statutes, is amended by adding section 16-242.01, to read:
16-242.01. Political party nominee; voting methods
A. For any political party that chooses not to participate in the publicly administered presidential preference election and that chooses to select a nominee for president by way of a vote that is open to the entire membership of the political party, the following apply:
1. the political party shall provide for a method of voting that allows all of the following to participate:
(a) Persons who are absent uniformed services voters or overseas voters as defined in the uniformed and overseas citizens absentee voting act (P.L. 99-410; 100 stat. 924; 52 United States code section 20310).
(b) Persons with disabilities.
2. The political party in its sole discretion may choose the means employed for voting.
B. This section does not obligate a political party to hold a presidential preference election or select a nominee for president by popular vote.
