An Act
amending title 15, chapter 1, article 1, Arizona Revised Statutes, by adding section 15-120.04; relating to public schools.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 15, chapter 1, article 1, Arizona Revised Statutes, is amended by adding section 15-120.04, to read:
15-120.04. Administrative contracts; school districts; charter schools; early termination; definition
A. A school district governing board or charter school governing body shall include in each administrative contract that has a term exceeding one year a provision that:
1. Allows the school district or charter school to rescind or terminate the contract if the charter school or one or more schools operated by the school district have been assigned a letter grade of D or F pursuant to section 15-241.
2. Stipulates that if a contract is terminated pursuant to paragraph 1 of this subsection, the school district or charter school is not liable for damages for the early termination of the contract or for outstanding obligations under the contract.
B. For the purposes of this section, "administrative contract" Means an employment contract between a school district or charter school and an administrator of the school district or charter school Including, the superintendent and any employee with key decision-making authority over all or part of school DISTRICT or charter school operations.
Sec. 2. Applicability
This act applies to any new administrative contract executed after the effective date of this act.
