AN ACT
Amending Title 46, chapter 1, article 3, Arizona Revised Statutes, by adding section 46‑142; relating to the department of economic security.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 46, chapter 1, article 3, Arizona Revised Statutes, is amended by adding section 46-142, to read:
46-142. Employer report; employees receiving public benefits
A. On or before February 1 of each year, the department shall prepare a public health program beneficiary employer report to identify the fifty employers in this state that have the highest number of employees who received in the previous calendar year public assistance through the Arizona health care cost containment system, the Arizona long‑term care system, the children's health insurance program or temporary assistance for needy families. The department shall provide the report to the president of the senate, the speaker of the house of representatives, the chairpersons of the health and human services committees in the senate and the house of representatives, or their successor committees, and the governor and file a copy of the report with the secretary of state.
B. The report required in subsection A of this section shall include all of the following information:
1. The name and address of the employer.
2. The size of the employer.
3. The number of public assistance program beneficiaries who are an employee of that employer and the type of assistance received.
4. The number of public assistance program beneficiaries who are a spouse or dependent of an employee of that employer and the type of assistance received.
5. The cost to the state of providing public assistance program benefits for their employees and enrolled dependents, if available.
6. Whether the employer offered health benefits to its employees who are public assistance program beneficiaries and the number of such employees.
C. the report submitted pursuant to this section may not include the names of any individual public assistance beneficiaries and is subject to the privacy standards in the health insurance portability and accountability act of 1996. The department may establish interagency agreements to collect information to fulfill the requirements of this section.
Sec. 2. Short title
This act may be known and cited as the "Fair Share Employer Disclosure Act".
