AN ACT
Amending title 36, chapter 29, article 1, Arizona Revised Statutes, by adding section 36‑2903.08; relating to health care services contracts.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 36, chapter 29, article 1, Arizona Revised Statutes, is amended by adding section 36-2903.08, to read:
36-2903.08. Health care services; contracts; prohibition
A. An eligible person is prohibited from accepting compensation for entering into or fulfilling a service contract if the eligible person knows that fulfilling the services required in the contract will require the eligible person to receive health care services that are covered under this chapter and that are health care services that the eligible person would not receive if the person did not enter into or fulfill the service described in the contract.
B. Subsection A of this section does not apply if, before executing the contract, the eligible person arranges for a payor other than the administration to cover the health care costs that otherwise would be charged to the administration.
C. If an eligible person receives compensation for a service contract in violation of subsection A of this section, the administration may recover the costs of the health care services that were paid by the administration from the compensation that was received under the contract referenced in subsection A of this section. The administration may not recover more than the actual compensation received by the eligible person under the contract or the actual cost of the health care services received by the eligible person, whichever is less.
