AN ACT
amending title 18, chapter 1, article 1, Arizona Revised Statutes, by adding section 18-107; relating to software licensure.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 18, chapter 1, article 1, Arizona Revised Statutes, is amended by adding section 18-107, to read:
18-107. Public agencies; software licensure; prohibition; definition
A. A contract entered into by a public agency for the licensing of software applications designed to run on generally available desktop or server hardware may not limit the public agency's ability to install or run the software on the hardware of the public agency's choosing.
B. For the purposes of this section, "Public Agency" means this state, the Arizona board of regents or a city, charter city, county, district, public authority or other political subdivision of this state.
Sec. 2. Applicability
This act applies to any contract or addendum entered into from and after the effective date of this act.
