AN ACT
amending title 44, chapter 9, Arizona Revised Statutes, by adding article 26; relating to retail establishments.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 44, chapter 9, Arizona Revised Statutes, is amended by adding article 26, to read:
ARTICLE 26. RETAIL ESTABLISHMENTS
44-1382. Right to refuse service; notification to public; failure to leave; violation; classification
A. A person, including a business owner, manager or employee, who is engaged in a public business in this state may select with whom the person does business. The person may refuse to sell to, wait on or serve any person.
B. A business described in subsection A of this section may display a sign that notifies the general public that "the management reserves the right to refuse to sell to, wait on or serve any person". The display of the sign is not a prerequisite to exercising the authority prescribed by subsection A of this section.
C. If a person enters the premises of a business described in subsection A of this section and is requested or ordered to leave by the business owner, the manager or an employee, the person shall leave. A person who violates this subsection is guilty of a class 2 misdemeanor.
