An Act
amending title 36, chapter 4, article 2, Arizona Revised Statutes, by adding section 36-434.02; relating to health care institutions.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 36, chapter 4, article 2, Arizona Revised Statutes, is amended by adding section 36-434.02, to read:
36-434.02. Behavioral health inpatient facilities; detoxification services; licensure renewal; AHCCCS review
a. A behavioral health inpatient facility that provides detoxification services for persons with substance use disorder, as condition of license renewal, shall submit to the department an annual report as prescribed by section 36-2907.14, subsection B and the rules adopted pursuant to that section.
b. The DEPARTMENT shall coordinate with the Arizona health care cost containment system administration for the review of the annual report, regardless of whether the behavioral health inpatient facility is a contractor under chapter 29, article 1 of this title, and to receive comments from the city or town in which the behavioral health INPATIENT facility is located pursuant to section 36-2907.14, subsection C. THE DEPARTMENT must RECEIVE APPROVAL Of THE ANNUAL REPORT FROM THE ARIZONA HEALTH CARE COST CONTAINMENT SYSTEM ADMINISTRATION BEFORE RENEWing the behavioral health inpatient facility's license.
