An Act
amending section 26-403, Arizona Revised Statutes; relating to the emergency management assistance compact.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Section 26-403, Arizona Revised Statutes, is amended to read:
26-403. Emergency management assistance compact and Arizona mutual aid compact revolving fund; purpose; exemption; definitions
A. The emergency management assistance compact and Arizona mutual aid compact revolving fund is established consisting of monies appropriated by the legislature and monies received as reimbursement for costs incurred by this state and any supporting partners of this state, while rendering aid as prescribed in section 26-309 or 26-402, that respond to arizona mutual aid compact requests that are coordinated and approved by the division. Monies in the fund are continuously appropriated and are exempt from the provisions of section 35-190 relating to lapsing of appropriations. The department of emergency and military affairs shall administer the fund.
B. Monies in the fund shall be used for the costs incurred by this state while assisting other states with emergencies or natural disasters pursuant to section 26-402 or to reimburse supporting partners of this state AND agencies in this state that respond to arizona mutual aid compact requests that are coordinated and APPROVED by the division.
C. For the purposes of this section:
1. "arizona mutual aid compact" means a compact entered into pursuant to section 26-402.
2. "division" means the division of emergency management within the department of emergency and military affairs.
3. "supporting PARTNER" includes any county, city, town, private water or wastewater utility, special tAxing district or federally recognized indian tribe that has a fully executed Arizona mutual aid compact agreement.
